Welcome to Madrid: City of protests

Madrid (CNN)  -- Loud chants rise up from the street below, the noise bouncing off the wall of the building across the way and pouring in to an apartment on the top floor of a block in Vicalvaro, a working class suburb of Madrid. "The people, united, will never be divided!" yells the crowd, angrily waving banners and placards. "To fight is the only way!" Rocio pokes her head out of the window, watching the commotion below with interest, as dog-walkers, mothers with strollers, and pensioners carrying shopping bags join the throng. The scores of people gathering on the sidewalk are no nosey neighbors -- indeed, many of them are complete strangers to the family living on the fifth floor -- but they are all here to protect Rocio from eviction. El Constitucional avala la pensión de viudedad para parejas de hecho sin hijos

El Tribunal Constitucional entiende en una sentencia que las parejas de hecho no necesariamente tienen que tener hijos para tener derecho a la pensión de viudedad. El tribunal considera que la norma que exige ese requisito es “irrazonable” y que atenta contra el artículo 14 de la Constitución Española, que proclama la igualdad de las personas ante la ley. El TC responde así a una cuestión de inconstitucionalidad que planteó el juzgado de lo Social número 33 de Barcelona, hasta donde llegó una demanda de J. M. d F. porque la Seguridad Social le había negado la pensión de viudedad que reclamaba tras el fallecimiento de su pareja de hecho, con la que convivía desde 1982. El TC le da ahora la razón. La resolución cuenta con un voto particular en contra, del magistrado Francisco Pérez de los Cobos, porque considera que esta norma está justificada debido a la escasez de recursos de la Administración, limitados para atender casos de ese tipo.
